Some Courts require that a litigant “exhaust administrative remedies” before filing a lawsuit in the Court. “Failure to exhaust administrative remedies” is one of the easiest defenses to a lawsuit that will quickly get your matter dismissed (thrown out of Court). The Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), Department of Fair Employment and Housing (DFEH), and many public entities have complaint processes that should be utilized before using the Court as a last resort.
